TERMS OF USE
Last Updated at 6th Feb 2023 These Terms of Use (these “Terms”) represent an agreement between you and FlexPay Technologies (A product owned by Flexitech Group Limited). (“FlexPay Technologies”) and contain the terms and conditions governing your use of and access to our website at htpps://www.flexpay.co.ke and all affiliated websites, and merchant stores owned and operated by us (collectively, the “website”) our products, services, and applications (together with the website, the “services”).” You and “Your” mean the person who uses or accesses the Services. “We”, “Us”, and “Our” mean FlexPay Technologies and its successors, affiliates, and assignees. As used in these Terms, “FlexPay Technologies Account” means the account you have with us for the services. Your use of and access to the Services are subject at all times to these Terms and our Privacy Policy. Please read these Terms and our Privacy Policy carefully. By using or accessing the Services, you represent that you have read and understood these Terms and our Privacy Policy and you agree to be bound by these Terms and our Privacy Policy. If you do not agree to all the terms and conditions of these Terms and our Privacy Policy, do not use or access the Services.
AGREEMENT TO USE ELECTRONIC COMMUNICATIONS
Your Consent. You agree to use electronic signatures, receive SMS/emails notifications of your balances, notices, statements, communications and other items for all services provided to you under these terms and in connection with your relationship with us. This consent is to the extent permitted by governing laws. By accepting and agreeing to these Terms electronically, you represent that: (1) you have read and understood this consent to use electronic signatures and to receive Communications electronically; (2) you satisfy the minimum hardware and software requirements specified below; and (3) your consent will remain in effect until you withdraw your consent as specified below. Right to withdraw the consent Your agreement to continually receive the electronic communication shall remain in effect until you choose to withdraw it. In the case where you choose to opt out you can contact us at [email protected] or call 0719725060 for assistance. Your withdrawal from the electronic communication will lead to closing your FlexPay Account and in the case if there was any cash in the wallet it will be converted to a voucher with a charge fee of 7% deducted in the case you had an active booking which was not completed by the time of withdrawal of the consent. Keep your Current information with us. For us to be able to communicate to you efficiently keep with us your most current information and continuously update it in the case of any changes. This includes if there is a change in your Email Address or phone number. Hardware and Software Requirements. In order to access and retain Communications provided to you electronically, you must have: (1) a valid email address and valid Phone Number; (2) a computer or other mobile device (such as tablet or smart phone) that operates on a platform like Windows or a Mac; (3) a connection to the Internet; (4) a Current Version of Internet Explorer 8 (or higher), Mozilla Firefox 7.0, Safari 5, or Chrome 15; (5) a Current Version of a program that accurately reads and displays PDF files, such as Adobe Acrobat Reader version 7 or higher; (6) a computer or device and an operating system capable of supporting all of the above; and (7) a printer to print out and save Communications in paper form or electronic storage to retain Communications in an electronic form. "Current Version" means a version of the software that is currently being supported by its publisher. Changes. We reserve the right, in our sole discretion, to communicate with you in paper form. In addition, we reserve the right, in our sole discretion, to discontinue the provision of electronic Communications or to terminate or change the terms and conditions on which we provide electronic Communications. Except as otherwise required by applicable law, we will notify you of any such termination or change by updating these Terms on the Website or delivering notice of such termination or change electronically.
REQUIREMENTS REQUIRED TO USE THE SERVICE
a. First you have to accept to our terms & conditions and privacy policy. b. Create an account with us on our website, partner stores or third-party websites. c. Be of legal age as stipulated in the respective country laws to be able to use our platform. d. Provide all information requested by us, such as your name, email address, mobile number, online credentials for your FlexPay Account, and such other information as we may request from time to time (collectively, "User Information"). You represent and warrant that all User Information you provide us from time to time is truthful, accurate, current, and complete, and you agree not to misrepresent your identity or your User Information. You agree to promptly notify us of changes to your User Information by updating your FlexPay Account on the Website. e. For our compliance purposes and in order to provide the Services to you, you hereby authorize us to, directly or through a third-party, obtain, verify, and record information and documentation that helps us verify your identity. When you register for the Services and from time to time thereafter, we may require you to provide and/or confirm information and documentation that will allow us to identify you, such as: 1. A copy of your government-issued photo National ID, such as a passport or driver’s license; 2. A copy of a utility bill, bank statement, affidavit, or other bill, dated within three months of our request, with your name and country street address on it; 3. and such other information and documentation that we may require from time to time. The information you provide us is subject to our Privacy Policy.
HOW DO I USE THE SERVICES?
The purpose of our services is to help you create a goal for purchasing a high-end product, pay for holiday, rent, school fees and other services which are high cost by making partial payments on lay-by means. To access above products/Services you have to create an account with us then choose from the variety of services we have ranging from retail deals, holiday deals, school fees deals, rent goals, construction goals and then provide your details depending on the package you have chosen and from there a goal is initiated. For our retail deals You can visit any of our merchant outlets choose a product you want and our agents on the ground will help you initiate your booking automatically. Otherwise, visit www.marketplace.flexpay.co.ke on the Lipia Polepole option and enter details as requested and then click on reserve, this will automatically initiate a new booking and your wallet account automatically created on the FlexPay platform. For our offline customers who have no access to the internet they can use the USSD platform which is *384*30# to create an account with us. Then from there they are able to access our wide range of products and services and then create a goal, make partial payments with our lay-by platform and receive the statements via a text message.
HOW DO I CHECK MY BALANCE ON MY FLEXPAY ACCOUNT?
You can log in to your FlexPay Account and go to the wallet and then you will view your wallet balance from there. Consequently, dial *384*30# then choose customer and input your details and then from there choose Make a payment and you will be able to see the name of your product and the balance in brackets. Also, you can call us on our customer care number and your balance will be read out to you.
ARE THERE ANY FEES FOR USING THE SERVICES?
FlexPay services are absolutely free and convenient. The products and services booked within partner stores or websites are at 0% interest rate. We reserve the right to change and charge any fee in the future. We will notify you if we introduce a charge fee for our services in accordance to the governing laws.
PENALTY FOR GOAL/BOOKING CANCELLATION?
In the event a customer is unable to continue with the subsequent payments, then we don’t do cash refunds they will be entitled to a voucher worth the full amount of their payments. Voucher redeemable in any of our partner merchants. In the case of adverse situation and customer demands a cash refund for the defaulted booking a penalty fee of 7% of the total payment will be deducted and only 93% will be refunded to the customer.
